Terms of Service

The short version:

• You must be at least 13. Where a higher age applies, you must meet it or have a parent’s permission, as explained in section 2.
• What you write stays yours. We show it only to the people you send it to.
• Do not harass anyone and do not share what you have no right to share. We remove such content and close accounts that keep doing it.
• We link to music, we do not host it. Playback happens in your own music service.
• Sonatide is in early access: features change, and the service may be down at times.
• Serbian law applies; consumers keep the protection of their home country.

1. Who you are agreeing with

These terms are an agreement between you and Artur Rafikov PR Novi Sad, a sole trader registered in Novi Sad, Serbia, publishing as BinaryCascade (“we”). They cover the Sonatide apps and the website sonatide.app. By creating an account or using Sonatide you accept them. Our Privacy Policy explains how we handle your data and is part of these terms.

2. Who can use Sonatide

You must be at least 13. If your country sets a higher age for consenting to data processing (15 in Serbia, up to 16 in parts of the EU), you must be that age or have a parent’s permission. One account per person, in your own name. You are responsible for what happens under your account; do not share your credentials.

3. What Sonatide is, and is not

Sonatide lets you exchange songs and albums with other people. A letter is a music link with an optional note and mood; it includes details such as the title, artist and artwork. We do not host, stream or sell music. Playing a track happens in the music service you choose, under that service’s own terms and subscription. We do not control those services and cannot guarantee that a track exists on all of them or that a match between platforms is exact.

Sonatide is in early access. Features may change, be added or removed, and the service may be unavailable at times. We will try to warn you about changes that affect your content.

4. Your content

You keep every right to the notes, photos and other content you put into Sonatide. So that the service can work, you give us a licence to store that content, to show it to the people you send it to, and to make the copies needed for delivery and backups. The licence ends when you delete the content or your account, except for copies in backups (up to 30 days) and for letters already delivered, which remain in the recipients’ mailboxes without your name.

You promise that your content does not break the law or anyone’s rights, and that you have the right to share it.

5. Rules

Do not use Sonatide to:

• harass, threaten, bully or demean anyone, or keep writing to someone who asked you to stop;
• post hateful content, sexual content involving minors, or content that glorifies violence or self-harm;
• impersonate someone, or misrepresent who a letter comes from;
• send spam, bulk invites, advertising or malware;
• infringe the copyright, trademarks or privacy of others;
• scrape, overload, reverse engineer or otherwise interfere with the service, or access it other than through the apps we publish.

6. Reporting, blocking and enforcement

You can report letters and people from inside the app, and block people you do not want to hear from. They are not notified when you block them. The FAQ explains how. We aim to review reports within 24 hours. Content that breaks these rules is removed, and accounts that break them may be warned, suspended or closed, in serious cases without prior notice. When we remove your content or restrict your account, we tell you which rule it broke, and you can object by writing to hello@sonatide.app. Rights holders can report infringing content to the same address; we remove it and tell the author.

7. Invites and other people’s data

Invite links you create carry your name. Send them only to people who want to hear from you. Your correspondents’ names, photos and letters are shared with you so that you can write back; do not export or publish them elsewhere.

8. Ending things

You can delete your account at any time in the app (open Profile, select your name to open Account, then choose Delete account) or as described at Delete your account. We may end or change the service; if we shut it down, we will give at least 30 days’ notice so that you can export your data, unless a legal or security reason forces a faster stop.

9. Our intellectual property

Sonatide, its name, its mark and its apps belong to us. You get a personal, non-transferable licence to use the apps on devices you own, subject to these terms and to the rules of the store you got them from. Music metadata and artwork belong to their rights holders and to the platforms that provide them. Sonatide is not affiliated with, or endorsed by, Spotify, Apple, YouTube, TIDAL, Yandex, Last.fm or any other music service; their own terms apply when you use them.

10. No warranty

Sonatide is provided as is. We do not promise that it will be uninterrupted or error-free, or that every track will resolve on every platform. Nothing in this section limits the rights you have as a consumer under mandatory law.

11. Liability

To the extent the law allows, we are not liable for indirect losses, for data lost through third-party services, or for content other users send you. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim, which today is nothing. This does not exclude liability for intent, gross negligence, or anything that cannot be excluded under your local consumer law.

12. Apple and Google

If you got Sonatide from the App Store: these terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for the app, is not responsible for any claim relating to the app or your use of it (including product liability, consumer protection and intellectual property claims), and is a third-party beneficiary of these terms with the right to enforce them against you. You confirm that you are not located in a country under a United States government embargo and are not on any United States list of prohibited parties. Apple’s standard Licensed Application End User License Agreement applies where it does not conflict with these terms.

If you got Sonatide from Google Play, Google’s terms for the store apply to the download, and these terms apply to the service.

13. Law and disputes

These terms are governed by the law of the Republic of Serbia. Disputes go to the competent court in Serbia, unless you are a consumer in a country whose law lets you sue at home, in which case you keep that right. Before going to court, write to us: most problems are solved by email.

14. Changes

We may update these terms. For material changes we tell you in the app or by email at least 14 days before they take effect. Continuing to use Sonatide after that date means you accept the new terms.
